These Terms & Conditions (“Terms”) constitute a legal agreement between you (“you,” “User”) and UserCRO, Inc., a Delaware corporation doing business as Fuse (“Fuse,” “we,” “us,” or “our”). These Terms govern your access to and use of our website, platform, applications, software, and related services (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Services.
Fuse may update these Terms at any time. The latest version will always be posted at: https://fuse.is/terms-conditions. Continued use of the Services after updates become effective constitutes acceptance of the updated Terms.
Fuse provides an AI-native data intelligence platform that connects to your authorized marketing and business data sources (e.g., Google Analytics 4, Google Ads, Meta Ads, Shopify); retrieves and analyzes your data in real time without requiring SQL, ETL pipelines, dashboards, or manual reporting; uses proprietary AI agents and benchmarking to generate insights, recommendations, and presentation-ready narratives; and allows you to upload files or content (e.g., CSVs, PDFs, documents) for analysis.
Fuse may modify or improve the Services at any time.
The Services are intended for informational and strategic purposes. You are solely responsible for decisions based on AI-generated outputs.
You must be at least 18 years old to use the Services. If you use the Services on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.
3.1 Ownership
You retain all rights, title, and interest in any data retrieved from your connected sources, files or documents you upload, and any text, content, or materials you submit (“User Content”).
3.2 License to Fuse
You grant Fuse a worldwide, non-exclusive, royalty-free license to store, cache, process, analyze, display, and transform User Content; use User Content as necessary to provide, maintain, support, secure, and improve the Services; and generate AI-powered summaries, insights, recommendations, or data stories. This license ends when User Content is deleted from Fuse systems.
3.3 Data Storage, Caching & Retention
Fuse retrieves data directly from third-party APIs. Fuse may store or cache User Content—temporarily or persistently—as needed to operate or enhance the Services. Fuse may adjust its storage, caching, or retention practices as the platform evolves.
Fuse does not sell User Content. User Content is not used to train third-party AI models.
3.4 PII & Compliance
Fuse does not intentionally store personally identifiable information (PII) except where inherent to the data you connect or upload. You are responsible for ensuring compliance of your data sources with applicable laws.
Each party agrees to protect the other’s Confidential Information using reasonable care; use it only as permitted to provide or use the Services; and not disclose it to third parties except as required to perform the Services or as required by law.
These confidentiality obligations survive for two (2) years after termination of your account.
Fuse uses third-party AI services (e.g., Anthropic, OpenAI, Google) to assist with generating insights, summaries, and recommendations.
Fuse sends only the minimum necessary User Content to such processors; strips or minimizes PII whenever commercially feasible; and does not allow subprocessors to use User Content for training or advertising.
By using the Services, you consent to Fuse’s use of such subprocessors.
Fuse retains all rights, title, and interest in its software, code, architecture, AI models, prompts, algorithms, analytics, user interface and design, documentation, and all improvements or derivatives. No intellectual property rights are transferred to you.
If you provide ideas, suggestions, or feedback (“Feedback”), Fuse may use such Feedback without obligation or compensation. You grant Fuse a perpetual, worldwide, royalty-free license to use Feedback to improve the Services.
Fuse may offer free or promotional trials. Any such access is provided solely for internal evaluation; may be subject to additional terms (e.g., Order Forms, POs, or Trial Agreements); automatically converts to a paid subscription unless cancelled before the end of the trial; and is provided “as is” without warranties.
If trial-specific terms conflict with these Terms, the trial terms govern during the trial period.
9.1 Subscription Fees
Subscription fees must be paid in advance according to the selected billing cycle.
9.2 Automatic Renewal
Subscriptions automatically renew unless cancelled before the renewal date.
9.3 No Refunds
All fees are non-refundable, including for unused time, partial months, early cancellation, unused or expired AI credits, downgrades, or failure to use the Services. Refunds are provided only where required by law.
9.4 AI Credits
AI Credits represent compute usage and have no cash value. Credits do not roll over unless explicitly stated. If you run out of credits, you must upgrade your plan to continue using AI features. Fuse may adjust credit consumption logic as AI models evolve. Different prompts, analyses, data sources, or workloads may consume different amounts of AI Credits based on complexity, compute cost, and model usage.
You agree not to use the Services for unlawful, harmful, or fraudulent activities; access systems or accounts you are not authorized to use; interfere with Service operation or security; reverse-engineer or derive source code; scrape or misuse data from connected APIs; or upload harmful, infringing, or illegal content.
Fuse may provide shared workspaces allowing multiple users from your organization to access User Content. Workspace administrators are responsible for managing user permissions, adding or removing users, and controlling access to connected data sources. Fuse is not responsible for misuse of access by workspace users.
AI-generated outputs may contain inaccuracies, approximations, or omissions. Fuse guarantees the accuracy of raw data retrieved from authorized APIs, but does not guarantee the accuracy of AI-generated insights, predictions, or summaries.
You are responsible for validating AI outputs before acting on them.
You may cancel through your account settings at any time. Cancellation takes effect at the end of the current billing period. Fuse may suspend or terminate access for violations, security risks, or misuse. Upon written request, Fuse will delete User Content within a commercially reasonable timeframe, subject to legal retention requirements.
Fuse uses commercially reasonable security measures, including encryption and secure infrastructure. No system is completely secure. Fuse is not liable for damages from breaches, cyberattacks, or unauthorized access except where required by law.
To the fullest extent permitted by law, Fuse is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Fuse’s total liability in any 12-month period is limited to the fees paid by you during that period. During free trials, Fuse’s total liability is limited to $0. You agree to indemnify Fuse against claims related to your misuse of the Services.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any disputes will be resolved exclusively in the federal or state courts located in Delaware.
